Ban on Non-Essential Construction

On April 8, 2019, Governor Murphy issued Executive Order 122 which orders all non-essential construction to cease on, or before, 8pm on Friday, April 10, 2020. Within the Executive Order, exemptions are provided, in part, for projects: (1) already underway involving individual single-family homes with a construction crew of 5 or fewer; (2) already underway involving a residential unit for which a tenant or buyer has entered into a contract to occupy the unit by a certain date; (3) involving facilities that are critical to a business’ ability to function; (3) involving transportation projects; and (4) necessary for health care services. For those construction projects which continue, the Executive Order sets forth how work is to be undertaken while respecting social distancing.
